Course-Point.com Web Site Agreement – Monday 10th December 2018

The Course-Point.com Web Site (the “Site”) is an online information service provided by Course-Point.com (“www.course-point.com”), subject to your compliance with the terms and conditions set forth below.

Please read this document carefully before accessing or using the site. By accessing or using the site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use the site. www.course-point.com may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.

1.0 The term Course-Point.com’ or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

2.2 YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE.

2.3 You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials.

2.3 You agree to grant to Course-Point.com a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site (such as bulletin boards, forums and newsgroups) or by e-mail to Course-Point.com by all means and in any media now known or hereafter developed.

2.4 You also grant to Course-Point.com the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto.

2.5 You agree that you shall have no recourse against Course-Point.com for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Course-Point.com.

3.0 TRADEMARKS

3.1 Publications, products, content or services referenced herein or on the Site are the exclusive trademarks or service marks of Course-Point.com.

3.2 Other product and company names mentioned in the Site may be the trademarks of their respective owners.

4.0 Use of the Site.

4.1 You understand that, except for information, products or services clearly identified as being supplied by Course-Point.com, Course-Point.com does not operate, control or endorse any information, products or services on the Internet in any way. Except for Course-Point.com – identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties, which are not affiliated with Course-Point.com.

4.2 You also understand that Course-Point.com cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.

4.3 You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

4.4 You assume total responsibility and risk for your use of the site and the internet. Course-Point.com provides the site and related information “as is” and does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise information or service provided through the service or on the internet generally, and Course-Point.com shall not be liable for any cost or damage arising either directly or indirectly from any such transaction.

4.5 It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the service or on the internet generally. Course-Point.com does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected.

4.6 You understand further that the pure nature of the internet contains unedited materials some of which are sexually explicit or may be offensive to you. Your access to such materials is at your risk. Course-Point.com has no control over and accepts no responsibility whatsoever for such materials.

5.0 Limitation of liability

5.1 In no event will Course-Point.com be liable for

(i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service. Even if Course-Point.com or its authorized representatives have been advised of the possibility of such damages, or

(ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some regions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such regions, Course-Point.com liability is limited to the greatest extent permitted by law.

(ii) Course-Point.com makes no representations whatsoever about any other web site which you may access through this one or which may link to this Site. When you access a non-Course-Point.com web site, please understand that it is independent from Course-Point.com, and that Course-Point.com has no control over the content on that web site. In addition, a link to a Course-Point.com web site does not mean that Course-Point.com endorses or accepts any responsibility for the content, or the use, of such web site.

5.2 The minimum required age for anyone to register an account with Course-Point.com and purchase its products is 18 years old.  This is because our products contain information, advice and guidance that are aimed to give life changing results and may require the student to spent money to achieve these.  We have determined that this information, advice and guidance is not suitable for people under the age of 18, as in many cases, people of this age are not legally considered as adults and are identified as adolescents and are not financially responsible for their own welfare.

(i) If an adult, who is above the age of 18 years, registers themselves and allows someone younger than 18 to access any of the video courses and/or e-books that they may have purchased, then Course-Point.com is not liable for any negative impacts that the adolescent may experience as a result of what they read or view from our products.

(ii) Course-Point.com is not liable for any financial, personal, mental, psychological or physical harm that any person, who is under the age of accessing this information, may experience as a result of any of the products that we sell, if this access was facilitated by a person of 18 years of age or above.

(iii) If it is found that any registered member of Course-Point.com is under 18 years of age, then their account will be terminated immediately and no refund will be given for any products that they have purchased on Course-Point.com.

(iv) Course-Point.com will not be held liable for any negative impacts an underage registered member may experience through any of our products, as they have violated our Terms and Conditions of Service from the outset and put themselves at risk.

6.0 Refunds and Guarantees

6.1 Course-Point.com agree to give you 30 days to evaluate a Video course or e-book. If you find that in this time the product is not of your liking or suitable to your needs, then you need to contact Support via the Contact page and submit a form.  Allow 48 hours for a response.

6.2 Should the request for a refund be granted, then in the case of a Video course, your authorisation to view this will be revoked immediately and you will not have any further access to it via the course curriculum page.

6.3 Most video courses have a free introductory unit, which you can view before deciding to purchase the course.  After purchasing the course, you are allowed to view the first paid for unit and take the first paid for quiz only to qualify for a refund.  Therefore, a refund will only be issued if you have not commenced viewing a second paid for unit of the course.

6.4 In the case of an e-book, then we will refund the amount and require a confirmation that you have deleted the e-book from your storage.

6.5 From time to time we will have bulk product package offers, special offers and super discount offers, each of which are not bound by the 30 day refund guarantee, but will have their own guarantee conditions. It is up to you to review these conditions before purchasing.

7.0 Fair Use Policy

7.1 Course-Point.com allows for you to request a refund for any of it’s products within a given time frame and according to the conditions mentioned above.

7.2 Our Fair Use Policy however will limit how many times you can request refunds.  You will only be allowed one refund for a Video course and/or E-book within a two month period.  This means you need to be sure that you want to purchase this product and are confident that it will be suited to your needs.

7.3 Continual requests for refunds from repeat customers could end with their accounts being terminated and IP blocked from using Course-Point.com.

8.0 Indemnification

8.1 You agree to indemnify, defend and hold harmless Course-Point.com, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.

9.0 Third Party Rights

9.1 The provisions of paragraphs 2 (Use of the Service), and 3 (Indemnification) are for the benefit of Course-Point.com and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service.

9.2 Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

10.0 Term; Termination

10.1 This Agreement may be terminated by either party without notice at any time for any reason.

10.2 The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.

11.0 Miscellaneous

11.1 This Agreement shall all be governed and construed in accordance with the laws of the UK applicable to agreements made and to be performed in the UK.

11.2 You agree that any legal action or proceeding between Course-Point.com and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in the UK.

11.3 Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Course-Point.com’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Course-Point.com may assign its rights and duties under this Agreement to any party at any time without notice to you.
